The situation is muddled by legislation in many states that began suspending licenses for non-driving offenses, such as failure to pay child support. An exception is for unlicensed drivers caught for driving while intoxicated or who refuse a breathalyzer test. New York law allows a driver with a suspended license up to 10 offenses before facing a felony charge. As with Pennsylvania, another count is added to their license each time they fail to appear in court. People caught driving on a suspended or revoked license in New York initially face a misdemeanor charge and a $500 fine or 30-day jail sentence. In Pennsylvania first-time offenders face a $200 fine, and further revocations added to their record. Alaska courts may require first time offenders to serve up to 80 hours of community service in lieu of jail time. In Vermont, first time offenders can lose their license plates and face a prison term of up to two years and a fine of up to $5,000.
Although driving with a revoked or suspended license is commonly a misdemeanor in most states, penalties vary widely.
